“It's not the Affordable Care Act that is the problem. "posted a WPO commenter

"It is the disconnect between Internal Revenue Code Section 36B, as added by Section 1401 and § 1321(c) of the ACA."

"More specifically, under the ACA Congress does not authorize the IRS to allow a "Premium Tax Credit" to residents in the 33 states that operate exchanges set up by HHS. "

"The State of Oklahoma, through Pruitt v. Sebelius, is not seeking to overturn any part of Obamacare as some would have you believe, rather it is asking the courts to direct the government to enforce this part of the law. Obama just lost his motion to dismiss."
"Game over for Obamacare, folks.”
